Do AI agencies guarantee results? What a fair guarantee looks like

Short answer

Few AI agencies guarantee business results in 2026, and the guarantees published by the UK agencies checked here cover terms instead. On 7 November 2026 CodeLeap refunded in full if a client cancelled within the first 21 days of a build, and Augustova refunded a Starter build that failed its agreed acceptance tests, while saying it never guarantees hours saved, revenue or conversions. A fair guarantee covers what the agency controls.

Yarigai's guarantee is a payback check made before the build starts.

Yarigai is a done-for-you AI agency that builds these systems, so read this with that in mind. Every price and figure links to its source below. Read this page as Markdown.

Why AI agencies rarely guarantee results

Most writing on the subject treats an outcome guarantee as a warning sign. SEO.com's "7 AI SEO Agency Red Flags", updated 18 September 2026, puts guarantees of visibility first, because AI search results shift from one searcher to the next. The Black Sheep calls guaranteed rankings or returns "sales tactics, not performance commitments". Wellows, in an article updated 26 October 2026, says "AI is probabilistic, not deterministic" and lists platform changes, model drift and the client's data as reasons no agency can promise a fixed result.

Three things make outcome guarantees on an AI build hard to honour.

The model and its price can change after launch

AI providers change models on their own timetable. Google's Gemini API pricing page says that from 1 December 2026 every request to gemini-2.5-pro will route automatically to gemini-3.8-flash. On the same date Gemini 4 Argon's input price doubles from $2.00 to $4.00 per million tokens. An agency that guaranteed an outcome on the old model would be held to it on a different model with a higher bill.

Results depend on the client's data

An agent that answers from the client's documents is only as good as those documents. SpotDev, which sells a £5,000 data readiness assessment, says that if data is "scattered across spreadsheets, duplicated or full of gaps, that groundwork has to happen first". Wellows makes the same point. The agency rarely controls the data.

Hours saved depend on staff using it

A support agent saves hours only when the team sends enquiries through it. Adoption sits with the client, so a guarantee of hours saved asks the agency to promise something it can't enforce.

The kinds of guarantee, compared

Each kind moves a different risk onto the agency. The useful question is which risk you most need covered.

Refund window

CodeLeap offers what it calls "a satisfaction guarantee". Cancel within the first 21 days of a build and you get your money back in full. After that, it says its milestone structure means you only pay for delivered work. This protects you if the project starts badly. It says nothing about results.

Acceptance tests and delivery dates

Augustova's Starter packages list acceptance tests in a one-page scope. If the build can't pass them, the client gets a full refund, and if it isn't live within the stated working days, the client doesn't pay the second half. Augustova also states its limit plainly: "We never guarantee hours saved, revenue or conversions."

Performance-based pricing

Some AI software charges per result instead of guaranteeing one. Intercom charges $0.99 per Fin outcome, counted when a customer confirms the issue is resolved, stops asking for help after Fin replies, or Fin completes a workflow, including handoffs. The vendor carries the risk on each conversation, but you rent the system rather than own it.

Money back on missed outcomes

Ciela, which writes for AI automation agencies, lists four structures: a paid pilot with success criteria, a performance trigger that releases part of the fee, extending the work until an agreed outcome lands, and a money-back window. It recommends capping refunds, typically at the pilot fee, and warns "Never guarantee an absolute outcome you do not fully control."

Fixed price

A fixed price for a written scope guarantees cost, not results. Augustova, SpotDev and Softomate all publish fixed or "from" prices for defined packages. Check what the scope excludes, such as platform fees, usage and hosting.

Payback check before the build

A payback check decides whether to build at all. The agency sets out what the system replaces, what that costs a year and what the build costs, then declines the job if the build doesn't pay back. It covers the risk of buying something that was never going to earn its keep.

What a fair guarantee looks like

A fair guarantee names something the agency controls, measures it in writing and says what happens if it is missed.

  1. It covers a controllable promise: a delivery date, agreed acceptance tests, a fixed price or a response time.
  2. The success criteria are written before work starts and tested on your real inputs.
  3. The remedy is specific, such as a refund, a waived payment or a fix at no charge, and any cap is stated.
  4. It says what it excludes. Augustova's line on hours saved, revenue and conversions is an example.
  5. You can claim it without a long minimum term.
  6. You own the code, the data and the accounts, so you can leave if it fails.

UK law sets a floor under all of this. Section 13 of the Supply of Goods and Services Act 1982 implies a term that a supplier acting in the course of a business "will carry out the service with reasonable care and skill".

Red flags in an AI agency guarantee

  • A guarantee of visibility or rankings in AI search. SEO.com lists guaranteed visibility as its first red flag.
  • A guarantee of revenue or return on ad spend with no written method for measuring it.
  • Promises of perfect accuracy. Ciela gives "100 percent accuracy" as an example of what not to promise.
  • A refund that applies only after a minimum term or under conditions you can't check.
  • No written acceptance tests, and no monthly running cost on the quote.

How Yarigai's guarantee works

Yarigai's guarantee is one sentence: "If the build isn't profitable for you, we won't build it."

Before the client pays anything, the one-week blueprint puts the maths in writing. It states what the system replaces, what that costs a year and what the build costs. If the build doesn't come out ahead within the first year, Yarigai doesn't take the job.

A worked example uses the figures on Yarigai's homepage. A $500 a month tool is $6,000 a year. Ten hours a week of admin at $20 an hour is $10,400 a year. A build that replaces both has $16,400 of first-year cost to beat ($6,000 + $10,400), plus its own running costs.

A refund guarantee pays out after the work fails. Yarigai's rule applies before the work starts, so it doesn't depend on how a model behaves months later. The client owns the code, the data and the accounts from day one, and Yarigai quotes a fixed price after the blueprint. The AI agency cost survey and the guide on how to choose an AI agency cover the other terms worth comparing.

Common questions

Can an AI agency guarantee ROI?

Not honestly as a fixed outcome, because model changes, the client's data and staff adoption sit outside the agency's control. An agency can check the return before the build, guarantee delivery terms and price per result. Ciela, which writes for AI agencies, warns against guaranteeing "an absolute outcome you do not fully control".

Is a guaranteed result from an AI agency a red flag?

A guarantee of visibility, rankings or revenue usually is. SEO.com lists guaranteed visibility as the first of its seven AI SEO agency red flags, and The Black Sheep calls such promises sales tactics. A guarantee on delivery, acceptance tests or price is a normal contract term.

Do UK AI agencies offer refunds?

Some do, on stated terms. On 7 November 2026 CodeLeap refunded in full if a client cancelled within the first 21 days of a build, and Augustova refunded a Starter build that couldn't pass its agreed acceptance tests. Read the conditions before you sign.

What is performance-based pricing for AI?

You pay for each result rather than for a build. Intercom charges $0.99 per Fin outcome, counted once per conversation when the customer's issue is resolved or a workflow completes. You rent the system, so the vendor keeps the code and sets the price.

What does UK law require of an AI agency?

Section 13 of the Supply of Goods and Services Act 1982 implies a term that a business supplier will carry out a service with reasonable care and skill. It doesn't guarantee a result. Write the delivery date, acceptance tests and remedies into the contract.

What is Yarigai's guarantee?

"If the build isn't profitable for you, we won't build it." The one-week blueprint sets out what the system replaces, what that costs a year and what the build costs, and Yarigai doesn't take a job that doesn't come out ahead within the first year.
